aku bukanlah tau sangat pasal agama ni...tapi

Islamic Pawn Broking as a Micro-Credit Instrument

( This article was published in Business Times 7th June 2006)

By

Ust Hj Zaharuddin Hj Abd Rahman *

The prevailing economic environment presents a unique opportunity for the Islamic Pawn-Broking or Ar-Rahnu industry in Malaysia. In this industry, attractive returns await those able to manage the inherent risks and survive in an intensely competitive market. In a move to capitalise on a relatively untapped market, especially the interest-free pawn broking regime, Islamic banks and Islamic based pawn broking businesses are advised to look into this kind of Shariah-based product.

It is one of the micro-credit and financial instruments available to Muslims, especially those from the lower income group. There are about 140 Islamic pawn-broking outlets throughout Malaysia helping the lower-income groups obtain quick and easy access to cash. Unlike conventional pawn-broking, the repayment period under Ar-Rahnu is less stringent and in the event of a default resulting in the pawned item being sold off, any extra proceeds from the sale of the pawned item will be returned to the customer.

Islamic Pawn Broking services are popular with both financial institutions and consumers. Providing the customer with the option to obtain cash to fulfil immediate financial needs, this service secures short term financing through personal surety or pledge. Thus, the risk of incurring losses in this model is very low. Under the Ar-Rahnu principle, something you own (such as gold jewellery), is used as a surety against the credit. In practice, the bank will retain the gold as collateral, and charge for safekeeping service. The gold will be valued at the prevailing market price. The amount extended by the bank will be slightly lower than the market value of the gold. The safekeeping period is predetermined and agreed to by both parties. At the end of this period, the financing must be repaid to the bank and the collateral reclaimed. No interest is charged, but if the financing is not repaid within the agreed period, the bank retains the right to seize and auction off the gold used as collateral.

The main features of Islamic Pawn Broking are as follows:-

    * Ar-Rahnu or Pawn-Broking is an activity whereby a valuable item is collateralized to a debt, which may be utilized as payment should the debt not be repaid within the agreed period.
    * In the event that the debtor is not able to repay the debt, the pawned asset will be disposed of to settle the outstanding amount and any surplus will be refunded to the owner of the asset. However if the owner cannot be traced, it is the responsibility of the Islamic pawnbroker to place the fund in the Baitul Mal account.
    * A combination of three concepts are applied for the short term financing under Islamic Pawn broking, they are: -

a.  Qardhul Hasan

b.  Al-Rahnu

c.  Al-Wadi’ah

The Rahnu mode of operations entails:

1) Financing amount and gold value

td kwn mus ade pegi BANK RAKYAT tny pasal pajak gadai Ar-rahnu....

pe yg die btau mus....

1. die x amik faedah tp amik RM6.50 sebulan berbanding pajak gadai biase RM10 sebulan...
die kate 6.50 ni tuk insurans ngan kawasan tempat letak barang tuh & sebagainya....bkn upah simpan...

2. kalo pajak kt tempat besa....die bg kite pnjm 50% dr harga asal jer....tp Ar-rahnu ni 75%....
so kalo harge barang kemas emas kite 1000.....kalo kt kedai pajak besa kite leh dpt 500 je...tp kt          ar-rahnu kite leh dpt 750....

3. kalo kt pajak besa....lepas tempoh yg diberi...kalo kite x sempat tebus die akan automatik lelong....
tp kalo ar-rahnu....die akan automatic tambah tempoh 2 bln & 4 bulan & smpi 6 bulan....kalo xleh gk die akan tlg lelong....die akan selesaikan hutang kite lu.....kalo ade lebih die akan bg  kite....tp pajak biase die akan lelong n amik kt die......

pe l huh...lupe la...

so mus pk..kalo kite sengkek sgt.....
gadai je kt ar-rahnu...jgn kat kedai besa n pling truk along2 bukit beruntung.....

ok....

pajak gadai ar rahnu ni kalau yg betul2 terdesak barulah guna, yg tak ada hal sebaiknya elakkan..kata sorang pensyarah kat UM ni pun mengamalkan sistem riba jugak cuma dimurnikan dgn word islamic..sistem pajak gadai sebenar..u gadai 100 u tebus blk 100, no charge simpanan ke, apa ke..dia tak mau kata dikenakan faedah/bunga./riba dia tulis lah charge simpanan...islamic ke tu..anyway mana blh tak ambil keuntungan kan..so they can create all sort of names utk menghalalkan business...

winamp05 posted on 19-9-2011 12:34 PM

- (Al-Baqarah 2:275)

Bila meminjamkn wang dgn cagaran/upah/faedah (riba) dijadikan urusniaga (ar-rahnu)...itulah perbankan konvensional yg di'Islam'kn.

cucur posted on 22-9-2011 11:38 AM

Upah simpan ar-rahnu dikenakan atas jumlah 0.75% sebulandr jumlah emas semasa dipajakkan. TETAP.

Cth yer.... katekan emas semasa dipajakkan rm5k..tetapi anda layak meminjam rm3,750 shj (70% dr nilai emas) upah simpannyer rm37.50 sebulan... katekanlah anda nak pinjam rm3k shj..upahnyer tetap sama.

upah dikire atas harga barang yg dicagar bukan duit yg di pinjam. kenapa? MUNGKIN tggung jawab arrahnu atas barang bukan atas pinjaman.

Setakat apa yg saya faham sahaja.(pendapat peribadi semata-mata)

Bole kate mcm...'cagaran atas pinjaman dgn nilai yg lbh tinggi' ?
