Make no bones about it. Halle Berry didn't get dumped by Gabriel Aubry. Their split happened several months ago – and it was the actress who initiated it, according to a source.

"She kicked him out months ago because he wasn't able to pull his weight in the relationship and she wanted to move on," a source close to Berry and Aubry tells PEOPLE.

"They’re very amicable in healthy ways because of their child," adds the source referring to the couple's 2-year-old daughter Nahla. "Her main concern is for the health and happiness of her daughter."

As for the so-called "mystery guy" Berry was photographed holding hands with in New York City on Friday night, "they’re old friends,” says the source. "The photographers were chasing them so he just instinctively grabbed her hand."

Meanwhile, a rep for Berry confirms to PEOPLE that she and Aubry "have been split for some time, but remain friends and committed parents to their daughter."

On Friday, Aubry released a statement to Access Hollywood saying the couple are putting daughter Nahla's happiness first.

Things are apparently getting tense between Halle Berry and Gabriel Aubry in the battle over custody of their daughter, Nahla Ariela Aubry.

Berry is scheduled to spend three months shooting in South Africa leaving Aubry worried that it may be difficult for him to see his daughter at this time. This led the model to consider his legal options with regard to gaining permanant custody. A source told Radaronline.com,

It’s been pretty difficult for Gabriel to see Nahla the last few weeks. He’s really getting sick of it and it’s getting to the point where he is seriously considering his options regarding pursuing permanent custody. He refuses to give up rights to his daughter, he loves her more than anything and is determined to be a regular, full time fixture in her life.”

Gabriel refused to spend three months away from his daughter with Halle scheduled to film during July, August and September. As the two tried to come to an arrangement things began to get heated. The source said,

Gabriel requested that he be allowed to keep Nahla with him in Los Angeles but Halle wouldn’t let that happen, so the two reached a total stalemate and it started getting nasty, with both of them looking into entering a legal battle.”

The source continued,

In the end they reached an agreement. Basically Halle is going to pay Gabriel to be a kind of full time nanny and to come to South Africa for the three months she’s there, and to be Nahla’s full-time caregiver.
Halle has a huge house that’s being rented for her and she and Gabriel are going to try to live under the same roof and get along for the sake of Nahla.
